  5. ATTENTION: READ CAREFULLY: By using, copying, or distributing the
  6. accompanying software you indicate your acceptance of the following
  7. Freeware License Agreement ("Agreement").

  9. 1. LICENSE. Alexander A. Sorkin aka Kibi ("Author") hereby grants you 
  10.    (each licensee is addressed as "you") a non-exclusive, transferable 
  11.    license to use his software product and accompanying documentation 
  12.    (the program's object code and documentation are collectively referred 
  13.    to as the "Software") on the following terms. You may:
  14.  
  15.    a. use the Software on any computer in your possession;
  16.  
  17.    b. make copies of the Software; and
  18.  
  19.    c. distribute the Software (subject to the requirements of Section 2 below)
  20.    only in the form originally furnished by the Author with no modifications 
  21.    or additions whatsoever. If you have the slightest doubt that your copy of
  22.    the Software is not original, you must contact the Author for an original
  23.    copy.

  25. 2. LIMITATIONS ON LICENSE. The license granted in Section 1 is subject
  26.    to the following restrictions:

  28.    Distribution of the Software are permitted provided that the following
  29.    conditions are met:

  31.    a. distributions must reproduce the above copyright notice, this list 
  32.    of conditions and the following disclaimer in the documentation and other
  33.    materials provided with the distribution;

  35.    b. distribution of the Software to third parties must be must be free of 
  36.    charge (no payment of money or otherwise, whether direct or indirect). 
  37.    However, fee for media, packaging and shipping of the Software may be 
  38.    recovered;

  40.    c. any commercial distribution must be expressly authorized by 
  41.    the prior written consent of the Author.

  43. 3. DISTRIBUTION: As used in this Agreement, the term "distribute" (and
  44.    its variants) includes making the Software available (either
  45.    intentionally or unintentionally) to third parties for copying or
  46.    use, including providing timeshare access. Each time you distribute
  47.    the Software, the recipient must expressly agree to comply with
  48.    these terms and conditions. The recipient automatically receives
  49.    this license to use, copy, or distribute the Software subject to
  50.    these terms and conditions. You may not impose any further
  51.    restrictions on the recipients' exercise of the rights granted
  52.    herein. You are not responsible for enforcing compliance with this
  53.    Agreement by recipients.

  55. 4. NO WARRANTY.

  57.    BECAUSE THE SOFTWARE IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTY 
  58.    FOR THE SOFTWARE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN
  59.    OTHERWISE STATED IN WRITING THE AUTHOR PROVIDES THE SOFTWARE "AS IS" WITHOUT
  60.    WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT
  61.    LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR 
  62.    A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE
  63.    OF THE SOFTWARE IS WITH YOU. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME
  64.    THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

  66.    IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING SHALL
  67.    THE AUTHOR BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL,
  68.    INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO
  69.    USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING
  70.    RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE
  71.    OF THE SOFTWARE TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF THE AUTHOR HAS
  72.    BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  74. 5. TERMINATION. The license granted hereunder is effective until terminated 
  75.    by the Author. You may terminate it at any time by destroying the Software.
  76.    This license will terminate automatically if you fail to comply with the
  77.    limitations described above. On termination, you must destroy all copies 
  78.    of the Software. The termination of your license will not result in the
  79.    termination of the licenses of any distributees who have received rights to
  80.    the Software through you so long as they are in compliance with the
  81.    provisions of this Agreement.
